By accessing and using Promptify ("the Service"), operated by ImgPromptify ("we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

Promptify is an owner-operated digital shop offering a curated collection of AI art prompts created and managed by ImgPromptify. All prompts available on the Service are created, selected, and maintained by us. The Service provides:

• Access to our curated library of AI art prompts
• Credit-based purchasing system for premium prompts
• Playground feature to test prompts with AI image generation
• Prompt text, parameter configurations, and example images

Important: Promptify is NOT a marketplace or platform that enables third-party sellers. We are the sole seller of all products and services offered through this Service.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Credit System and Purchases

Promptify operates on a credit-based system. When you purchase credits:

• All prices are displayed in USD and are subject to change without notice
• Payment is processed securely through our payment processor (Paddle)
• Credits are added to your account immediately upon successful payment
• Credits can be used to purchase prompts or generate images in Playground
• Credits are non-transferable and tied to your account
• We reserve the right to refuse or cancel orders at our discretion

Seller Information: ImgPromptify is the sole seller of all credits and prompts. All transactions are directly between you and ImgPromptify.

5. License and Usage Rights

Upon purchasing a prompt with credits, you are granted a non-exclusive, non-transferable license to:

• Use the prompt for personal or commercial AI art generation
• Modify the prompt for your specific needs
• Create and sell artwork generated using the prompt

You may NOT:

• Resell, redistribute, or share purchased prompts with others
• Use prompts to create competing prompt libraries or services
• Claim ownership of the original prompt text

6. Intellectual Property

All prompts, content, and materials available on the Service are owned by or licensed to ImgPromptify. This includes but is not limited to:

• Prompt text and configurations
• Example images and visual content
• Website design and user interface
• Trademarks, logos, and branding

7. Refund Policy

8. Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or related systems

• Violate any applicable laws or regulations

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Prompts will produce specific results when used with AI platforms
• Any errors or defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ImgPromptify SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified terms.
